1. Eligibility: This Sweepstakes is open to legal U.S. residents residing in one of the 50 United States or the District of Columbia who are at least 18 years of age or the age of majority in their jurisdiction of residence, whichever is older, at time of entry. This Sweepstakes is sponsored by Tristar Products, LLC (“Sponsor”). Employees, officers and directors of Sponsor and its parent companies, affiliates, subsidiary companies, representatives, consultants, contractors, legal counsel, advertising, public relations, promotional, fulfillment, and marketing agencies or promotion partners (“Sweepstakes Entities”), and members of their immediate families (parents, children, siblings, spouse, regardless of where they live) or members of the same household (whether related or not) are not eligible to participate. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and to Sponsor’s decisions, which are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein. Sponsor reserves the right to verify the eligibility of winners. This Sweepstakes is in no way sponsored, endorsed, administered by, or associated with Facebook, Twitter or American Express Company.
2. How To Enter: Between 12:01 pm Eastern Time on November 28, 2016 and 11:59 pm Eastern Time on December 11, 2016 (the “Deadline Date”), go to https://powerairfryerxl.com/sweepstakes follow the instructions to complete and submit your entry form. Your entry must include all required information, including your full name and valid email address, to be eligible to win. Please note that uploading a photo is optional. Upon completion and submission of the entry form, you automatically will be entered with one (1) entry into the Sweepstakes. Entries submitted in geographic areas in which the entry is not permissible will be disqualified. If entries do not contain all required information, the entrant will be disqualified. In the event the Sweepstakes is entered via a mobile device, Message and Data charges may apply.
Limit one (1) entry per person/email address. Additional entries will be disqualified Automated or bulk entries or entries submitted by third parties will be disqualified. Entries must be submitted by the participant. No copies, facsimiles, or mechanical reproductions of the entry form will be accepted. Any attempt by any participant to obtain more than the stated number of plays and/or entries by using multiple and/or different identities, forms, email addresses, or any other methods will void that participant’s entries, and that participant may be disqualified at Sponsor’s discretion. Multiple participants are not permitted to share the same email address. In the event of a dispute as to any entry, the authorized account holder of the email address used to enter will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder to the Sponsor or forfeit the prize. Entries specifying an invalid, non-working, or inactive email address will be disqualified and ineligible to win. You must complete all required information to be eligible to enter. Incomplete, corrupted, or untimely entries are void and will be disqualified.
If entrant elects to submit an optional photo to Sponsor, entrant warrants and represents that his/her photo upload is original, does not contain any material that would defame or otherwise violate or infringe upon the rights of any third party, including patents, copyrights, trademarks or rights of privacy or publicity, and will not violate any federal, state or local laws or ordinances.
3. Prize: One (1) prize will be awarded. Prize consists of two (2) 5.3 QT Power Air Fryer XLtm machines and two (2) American Express Gift Cards, each in the amount of two hundred and fifty US dollars (US$250.00). The Approximate Retail Value (“ARV”) of the prize is seven hundred ninety eight US dollars (US$798.00).
Prize Conditions and Restrictions: Any and all applicable federal, state, and local taxes and all fees and expenses related to acceptance and use of prize not specifically stated herein are the responsibility solely of winner. Issuer terms and conditions apply to gift card; see front and back of gift card for terms. Except as indicated by Sponsor, the prize is not transferable and cannot be assigned, substituted or redeemed for cash; however, Sponsor reserves the right to substitute a similar prize of equal or greater value in Sponsor’s sole discretion. Sponsor will not replace a lost or stolen prize or components of a prize. Prize cannot be used in conjunction with any other promotion or offer. Only the number of prizes stated in these Official Rules is available to be won in the Sweepstakes.
Entry and/or acceptance of prize constitutes permission for the Sponsor and its agencies (if any) to use the winner’s name, hometown (e.g., city and state) and/or likeness for advertising and trade purposes without further compensation or authorization, worldwide and in perpetuity, in any and all forms of media, now known and hereafter devised, unless prohibited by law. For the avoidance of doubt, Sponsor shall have the right to publish winner’s name on Fusion Life Brands social media platforms and properties, websites and cookbooks.
4. Selection of Winner: On or about December 14, 2016, Sponsor will select the name of one (1) potential winner of the prize in a random drawing from among all entries received, and will notify the potential winner by email. The odds of winning are based on the number of eligible entries received. Except where legally prohibited, potential winner must sign and return, within three (3) days of being notified, an Affidavit/Declaration of Eligibility, Liability & Publicity Release in order to claim his/her prize. If the potential winner cannot be contacted in person via email after the first attempt to contact him/her, if the prize or prize notification is returned as undeliverable, if potential winner fails to sign and return the Affidavit/Declaration of Eligibility, Liability & Publicity Release within the required time period (if applicable), or in the event that a potential winner is disqualified for any reason, Sponsor will award the applicable prize to an alternate winner selected by a random drawing from among all remaining eligible entries. Only three (3) alternate drawings will be held, after which the prize will remain un-awarded. Verification of Potential Winners:
ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE SWEEPSTAKES. 5. General Conditions: This Sweepstakes is governed by the laws of the United States. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and to Sponsor’s decisions, which are final and binding in all matters related to the Sweepstakes. The Sweepstakes Entities are not liable for lost, late or incomplete entries; any malfunctions or failure of any network or lines, computer internet system, servers or providers, computer equipment, software, failure of any email on account of technical problems or traffic congestion on the internet or at any website, or any combination thereof, including any injury or damage to participant’s or any other person’s computer related to or resulting from participation or downloading/uploading any materials relating to this Sweepstakes, or other technical difficulties or failures or other errors of any kind, whether human, mechanical, electronic or otherwise. If, for any reason, the Sweepstakes cannot be run as planned, Sponsor may, in its sole discretion, void any suspect entries and (a) cancel or terminate the Sweepstakes (or any portion thereof); (b) modify the Sweepstakes or suspend the Sweepstakes to address the impairment and then resume the Sweepstakes in a manner conforms to the spirit of these Official Rules; and/or (c) award the prize at random from among the eligible, non-suspect entries received up to the time of the impairment.

Publicity; limitations of liability and releases: By participating in this Sweepstakes, entrant agrees that Sweepstakes Entities, Facebook, Inc., and their parent companies, affiliates, subsidiaries, representatives, consultants, contractors, legal counsel, advertising, public relations, promotional, fulfillment and marketing, website providers, web masters, and their respective officers, directors, employees, representatives, and agents (the “Released Parties”) will have no liability whatsoever for, and shall be held harmless by entrants against, any liability for any injuries, losses or damages of any kind to persons, including personal injury or death, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse, or use of the prize, entry or participation in this Sweepstakes or in any Sweepstakes related activity, or any claims based on publicity rights, defamation or invasion of privacy, or merchandise delivery. The Released Parties are not responsible if the prize cannot be awarded due to cancellations, delays, or interruptions due to acts of god, acts of war, natural disasters, weather, or terrorism.
IF ANY USE BY ANY SWEEPSTAKES ENTITY OF THE OPTIONAL PHOTO SUBMITTED BY ENTRANT CAUSES SUCH SWEEPSTAKES ENTITY TO BE LIABLE TO ANY THIRD-PARTY, SUCH ENTRANT AGREES TO INDEMNIFY SUCH SWEEPSTAKES ENTITY AND ITS AGENTS, EMPLOYEES, AFFILIATES, SUBSIDIARIES, REPRESENTATIVE AND ALL RELATED PARTIES FROM AND AGAINST ANY AND ALL DAMAGES, COSTS, JUDGMENTS AND EXPENSES (INCLUDING REASONABLE ATTORNEY FEES) WHICH IT INCURS AS A RESULT OF ITS USE OF THE PHOTOS. PHOTOS WILL NOT BE RETURNED TO ENTRANTS.
7. No Recourse to Judicial or Other Procedures/Severability: To the extent permitted by law, the rights to litigate, to seek injunctive relief or to make any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with this Sweepstakes are hereby excluded, and any entrant expressly waives any and all such rights. In the event that the foregoing waiver is not enforced, entrants hereby (a) consent to the jurisdiction and venue residing exclusively within the federal or state courts sitting in Passaic County in the State of New Jersey, U.S.A, (b) agree that any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and (c) agree that, under no circumstances, will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Entrants agree that these Official Rules are governed by the laws of the State of New Jersey, without reference to principles of conflicts of law.
